CODE OF CONDUCT OF KTC CANNED FOODSTUFF MANUFACTORY (KTCFOOD)
KTC Canned Foodstuff Manufactory (KTCFOOD) is committed to fully fulfilling its social responsibility in all business activities, contributing to the sustainable development of the community and the environment. We are committed to:
- Management system
KTCFOOD applies the principles of the amfori BSCI Code of Conduct across all business functions and throughout the entire system.
- Employee participation and protective measures
KTCFOOD clearly informs employees about their rights and responsibilities, while also protecting them in accordance with the principles of the BSCI Code of Conduct.
- Freedom of association and the right to collective bargaining.
KTCFOOD facilitates all employees’ participation in organizations, allowing them the freedom to elect representatives to negotiate with the management. KTCOOD ensures that employee representatives will not face discrimination, harassment, threats, or any form of disadvantage from the company. Additionally, it provides the necessary conditions for representatives to interact with union members in the workplace.
- Non-discrimination
KTCFOOD is committed to ensuring non-discrimination in areas such as recruitment, salary payment, training, development opportunities, promotion, termination of employment, or retirement based on gender, age, religion, origin, social background, disability, ethnicity, religion, or any other condition that could lead to discrimination.
- Fair compensation
KTCFOOD adheres to this principle by respecting the rights of employees to receive fair wages, sufficient to ensure a decent standard of living for themselves and their families, as well as the social welfare benefits prescribed by law.
KTCFOOD always complies with at least the minimum wage set by the government or the industry standards approved through collective bargaining, whichever is higher. Wages must be paid on time, regularly, and entirely in legal tender. The wage level should reflect the skills and education of the employee and be related to regular working hours. Deductions are only allowed under the conditions and within the scope prescribed by law or determined by collective agreements.
- Reasonable working hours
KTCFOOD complies with the current legal regulations regarding working hours, rest periods, holidays, and public holidays as stipulated by labor law, collective labor agreements, relevant policies, and adheres to international standards for specific exceptions.
The use of overtime is considered an exception, voluntary, with rest periods arranged, and wages paid in accordance with current regulations.
- Occupational health and safety
KTCFOOD adheres to this principle to respect the rights of employees and provide a working environment that ensures safety and health, minimizing to the lowest possible level any hazards that may pose risks to employees and the local community.
Periodically or as needed, the factory assigns staff to participate in training courses and work guidelines on occupational safety, first aid, and fire prevention and fighting for employees in the factory, as well as providing additional training for new employees.
KTCFOOD follows procedures to identify risks to occupational safety and employee health. It maintains records of workplace accidents, analyzes their causes, and implements effective preventive measures to avoid recurrence.
KTCFOOD has established a Labor Protection Council to ensure that employees are properly equipped in accordance with the conditions and hazards of their work.
KTCFOOD fully implements legal benefits and regulations for female workers, pregnant employees, and those with young children.
Employees have the right to leave a place where serious danger is imminent without KTCFOOD permission.
- No child labor.
KTCFOOD ensures that no form of child exploitation, forced labor, or harmful work conditions for children are applied. The factory only employs workers who meet the legal minimum working age (from 15 years old), and does not directly or indirectly hire children below the legal working age.
KTCFOOD establishes strict age verification mechanisms as part of the recruitment process and ensures that workers are not demeaned or disrespected in any way.
KTCFOOD implements and maintains strict measures in the recruitment process to ensure compliance with this principle. In the rare event that child labor is discovered, the factory will cooperate with the relevant child welfare authorities to address the situation and assist the child laborer in continuing their education. If the worker does not wish to attend school, the factory will work with the family to create the best possible conditions, in line with the worker’s legal wishes, ensuring that their rights, health, and development are not negatively impacted.
- Special protection for young workers
KTCFOOD adheres to this principle to ensure that young workers (from 15 years old to under 18 years old) do not work overtime, do not work at night, and are protected from working conditions that may harm their health, safety, morals, and development.
When hiring young workers, KTCFOOD must ensure that the nature of the work is light, does not harm their health or development; working hours comply with current regulations and do not interfere with their schooling; and the company provides support and prioritizes their learning conditions.
- No precarious work.
KTCFOOD does not engage in, or through business partners, condone any form of slavery, forced, bonded, trafficked, or involuntary labor, and always adheres to international principles of responsible recruitment.
All employees have a clear labor contract that ensures full benefits and complies with legal regulations.
KTCFOOD ensures that all forms of recruitment are fair, transparent, and does not extend probation periods or use temporary labor to evade responsibilities or affect the legal rights and benefits of employees.
Employees have the right to access clear and transparent information about their contracts, wages, working conditions, and are entitled to insurance and benefits as per regulations. They are also protected against forms of precarious labor.
- No bonded labor, forced labor or human trafficking
KTCFOOD does not engage in or support the use of forced or compulsory labor, nor does it require employees to deposit or surrender identification documents to the factory as a condition of employment. The factory does not participate in or support human trafficking activities.
KTCFOOD does not withhold any part of wages, benefits, or property, does not delay wage payments, and does not mandate overtime. Additionally, employees have the right to leave the workplace once their working hours for the day are completed and are entitled to terminate their labor contract with appropriate notice to the employer.
KTCFOOD is committed to treating individuals with respect for their dignity and personal integrity, refraining from participating in or condoning physical or psychological punishment, oppression, violence, or any offensive language towards individuals.
- Disciplinary practices
KTCFOOD always treats employees fairly and respectfully, without applying or condoning the use of physical or mental coercion, punishment, or humiliation of employees.
- Environmental protection
KTCFOOD ensures the implementation of safety and environmental measures, specifically:
– Periodically 4 times/year, implement the program to monitor air and water quality in accordance with regulations.
– Have appropriate collection and storage measures for hazardous waste and sign a transportation and treatment contract with a competent unit.
– Install fire alarm system and necessary tools to effectively perform fire prevention and fighting work within the Factory.
– Schedule regular monitoring and inspections to ensure that systems and safety aids are operating in good condition.
- Compliance with laws and business ethics
KTCFOOD complies with the laws and current regulations of Vietnam, applying provisions aimed at improving, benefiting, and being suitable for employees.
